BY ENTERING THIS CONTEST, YOU AGREE THAT YOUR ENTRY AND THE PERSONAL INFORMATION COLLECTED FROM YOU IN CONNECTION WITH THIS CONTEST WILL BE HANDLED SUBJECT TO THE PDHengineer.com PRIVACY POLICY THAT CAN BE VIEWED AT https://www.pdhengineer.com/privacy-policy/. THE SPONSOR OF THIS CONTEST IS PDHengineer.com, A SUBSIDIARY OF DECATUR PROFESSIONAL DEVELOPMENT, LLC.

OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (COLLECTIVELY, THE “ELIGIBILITY AREA”) WHO ARE 18 YEARS OF AGE OR OLDER AND LOCATED IN THE ELIGIBILITY AREA AT THE TIME OF ENTRY. 1. ELIGIBILITY: Open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at time of entry. The following individuals are not eligible: employees, contractors, directors and officers of Decatur Professional Development, LLC or any of its subsidiaries, distributors, web design, advertising, fulfillment, judging and Contest agencies involved in the administration, development, fulfillment and execution of this Contest and any related sweepstakes (collectively, the “Contest Parties”), and the immediate family members (spouse, parent, child, sibling and spouse or “step” of each) and those living in the same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest) of each such employee, contractor, director or officer.

2. CONTEST SCHEDULE: You may enter the Contest between 09:00:00 am Central Time (“CT”) on January 30th, 2023, and 11:59:59 am CT on February 12th, 2023 (“Contest Entry Period”).

3. TO ENTER: To enter the Contest, log on to https://www.pdhengineer.com (“Web Site”) during the Contest Entry Period and enter your information into the contest popup window that will appear or use the form located at https://www,pdhengineer.com/pick-winner-entry/. All fields are required. One “Valid Entry” can be entered per eligible entrant per day. The second and subsequent daily entries will be discarded. A “Valid Entry” is defined as a properly completed entry form containing the first and last names, email address, and state of residence of one licensed professional engineer along with a prediction of the winner of the football game to be held on February 12, 2023. To be considered valid, all information requested by the entry form must be completed and correct. Email addresses must be valid and the entrant must be a Professional Engineer licensed by a state engineering board in the “Eligibility Area.” Contest entries are accepted only through the use of the online form. Each “Valid Entry” in which the winning team has been selected will result in one chance in the random drawing to select the Prize Winners.

4. ELIGIBILITY VERIFICATION: may be required prior to any prize being awarded. This verification may extend to any of the contest rules and may consist of a notarized affidavit or other verification as may be determined by the Sponsor. Any information requested by the Sponsor to verify eligibility must be provided within 10 days, or another alternate winner may be chosen at the judges’ discretion. All decisions of the judges are final.

5. SELECTION OF WINNER: Each “Valid Entry” indicating the correct winning team of the game on February 12, 2023, will be entered in a random selection drawing and three winners shall be drawn. The odds of winning depend on the number of entries received. Each entry predicting the winning team will have an equal chance of winning. The contest winners are subject to verification, including, without limitation, verification of eligibility, compliance with these Official Rules, and completion of release forms (described below). If attempted notification is returned as undeliverable, if a winner cannot be verified, or if a winner is otherwise unable to accept the prize, the prize will be forfeited and may be awarded to an alternate entrant. No entrant can win more than one prize.

Entrants agree that the Sponsors have the sole right to decide all matters and disputes arising from this Contest and that all decisions of Sponsors are final and binding. Finalists agree to release, indemnify, and hold harmless the Contest Parties from any and all liability, loss, damage, cost or claim related to any allegation regarding the acceptance or use or misuse of their prize.

6. PRIZES: Three (3) prizes will be awarded. Each prize is a package of prepaid credits that can be redeemed for online courses and / or webinars totaling fifteen (15) “PDH” redeemable only on PDHengineer.com. A “PDH” is defined as one credit of continuing education applicable to the renewal of a Professional Engineering license licensed by a state engineering board in the “Eligibility Area.” Each prize has an approximate retail value (“ARV”) between $449.25 and $898.50 with the actual retail value dependent on the winner’s selection of courses and webinars. Winners will be asked to select courses within thirty (30) days of the prize being awarded. The courses can be completed at any time within 24 months of the award date. Prizes can only be used by the named winner and cannot be transferred to another. In the event a winner is determined to be ineligible, another winner will be chosen randomly from the eligible entries. If a prize is not claimed in 10 days, an alternate winner will be selected. Each prize may be advertised as “a years’ worth” of “PDH.” This definition is based on the average required number of hours required for PE license renewal in the Eligibility Area. By entering, you acknowledge that this is an acceptable definition and, if a different number of PDH is required for one or more of your licenses, no action will be taken against the Sponsor.

7. GENERAL CONDITIONS: The prize winners are solely responsible for any taxes on their respective prizes and will receive an IRS Form 1099 for the ARV of their prize. No substitution of prize is offered, except at the sole discretion of the Sponsors. Prizes are non-transferable. By participating, Entrants agree to these Official Rules, which are final and binding in all respects. Finalists will be notified by e-mail on or around February 14, 2023 and will be required to provide further contact information including phone numbers and address and complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within ten (10) days of first attempted notification or an alternate Winner may be selected. If for any reason the Contest is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsors reserve the right, at their sole discretion to cancel, modify or terminate the Contest. Further, Sponsors reserve the right, at their sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or any Sponsor or Contest website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules, or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsors reserve the right to require a potential Prize winner to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring Contest Parties into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by Sponsors in their sole discretion. This Contest is offered only in the United States and is governed by the laws of the state of Texas. All claims relating in any manner to this Contest or to any Submission must be resolved in the federal or state courts located in Harris County, Texas and all Entrants hereby consent to the personal jurisdiction in such venue.

8. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsors or Contest Parties resulting from any user’s participation in or attempt to participate in the Contest or ability or inability to upload or download any information in connection with participating in the Contest. No responsibility or liability is assumed by the Contest Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Contest. The Contest Parties are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. Sponsors and the Contest Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site. By participating in the Contest, the Entrant releases Sponsors and Contest Parties from any and all claims, damages or liabilities arising from or relating to such Entrant’s participation in the Contest. By accepting a prize in the Contest, winners agree that the Sponsors and Contest Parties shall not be liable for any loss or injury resulting from participation in the Contest and acceptance or use or misuse of any prize. Contest Parties are not liable in the event that any portion of the Contest is cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”). Each Entrant hereby acknowledges and agrees that the relationship between the Entrant and the Contest Parties is not a confidential, fiduciary, or other special relationship, and that the Entrant’s decision to provide the Entrant’s Submission to Sponsors for purposes of the Contest does not place the Contest Parties in a position that is any different from the position held by members of the general public with regard to elements of the Entrant’s Submission. Each Entrant acknowledges and agrees that the Contest Parties do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the Entrant’s copyright in and to the Submission. Finally, each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of any Contest Parties’ actual or alleged exploitation or use of any Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of any video game or other material or production based on or allegedly based on the Submission, and Entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law. 9. DATES & DEADLINES/ANTICIPATED NUMBER OF ENTRANTS: Because of the unique nature and scope of the Contest, Sponsors reserve the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Contest. Sponsors cannot accurately predict the number of Entrants who will participate in the Contest.
